By engaging our services and making any payment, you agree to this Refund Policy in addition to our Terms of Service.
1. Nature of our services
Ena Ema Technologies provides custom professional digital services, including consulting, design, development, and related services. Our services are:

➡ Time-based and capacity-based
➡ Performed according to agreed scopes and timelines
For these reasons, payments are treated differently from product or subscription purchases.
2. Jurisdiction and consumer rights
This Refund Policy applies to clients located in the United States, Canada, Australia, the United Kingdom, and the European Union.
Nothing in this policy limits any mandatory statutory consumer rights that may apply under local law. Where such rights apply, they are respected. In all other cases, refunds are governed strictly by this policy and the applicable service agreement.
3. Business vs consumer engagements
Our services are provided primarily to businesses, founders, and professionals.
Where services are purchased for business purposes, consumer protection laws may not apply. Where a client qualifies as a consumer under applicable law, statutory rights will apply subject to the nature of custom digital services.
4. Deposits and upfront payments
Unless explicitly stated otherwise in writing:
➡ All deposits and upfront payments are non-refundable
➡ Deposits secure project scheduling, availability, and allocation of professional time
➡ Once services begin, reserved resources cannot be reallocated or resold
5. Payments for completed or in-progress work
Payments made for:
➡ Completed milestones
➡ Delivered work
➡ Approved phases
➡ Work already in progress
are non-refundable.
Refunds do not apply to time, labour, planning, or resources already committed.
6. Client cancellation
If you choose to cancel a project:
➡ You remain responsible for payment for all work completed up to the cancellation date
➡ Any outstanding invoices for completed work become immediately due
➡ No refunds will be issued for work already performed
Upon settlement of outstanding balances, completed deliverables may be provided where applicable.
7. Cancellation by Ena Ema Technologies
In rare circumstances where Ena Ema Technologies must terminate a project due to internal constraints or inability to proceed:
➡ You will not be charged for unperformed work
➡ Any prepaid amount for work not yet started may be refunded at our discretion
This does not apply where termination results from:
➡ Non-payment
➡ Misuse of services
➡ Breach of agreement
➡ Lack of required client input or communication
8. Right of withdrawal (EU and UK consumers)
If you are a consumer located in the European Union or the United Kingdom, you may have a statutory right to withdraw within 14 days of entering into a service agreement. However, this right does not apply once:
➡ You have requested that services begin immediately, and
➡ The services have been partially or fully performed
By making a payment and requesting project commencement, you acknowledge and agree that the right of withdrawal may be lost once work begins.
9. Delays and scope changes
Refunds are not issued due to:
➡ Delays caused by missing client inputs, feedback, or approvals
➡ Changes in scope or requirements after work has begun
➡ Shifts in business priorities or strategy
Scope changes are handled through revised timelines or pricing, not refunds.
10. Dissatisfaction with outcomes
Because creative and technical services involve professional judgment:
➡ Refunds are not guaranteed based on subjective preference or dissatisfaction
➡ Clients are encouraged to raise concerns promptly so reasonable revisions can be discussed, where applicable
Any revision entitlements are defined in the applicable proposal or agreement.
11. Chargebacks and payment disputes
Clients agree to contact Ena Ema Technologies first to resolve billing concerns. Unjustified chargebacks or payment disputes may result in:
➡ Immediate suspension of services
➡ Termination of engagement
➡ Recovery actions where permitted by law
12. Exceptions
Any refund exception must be:
➡ Explicitly agreed in writing
➡ Confirmed by an authorised representative of Ena Ema Technologies
Verbal assurances or assumptions do not constitute refund eligibility.
13. Governing law
This Refund Policy is governed by and construed in accordance with the laws of the United States, subject to mandatory consumer protection laws applicable in the client’s jurisdiction.
